Acted for a client in a court action concerning a dispute over the terms of business and the proper construction of a clause in relation to payment of client's fees. Although the amount involved was relatively modest, the principle of the matter and the need to clarify the meaning of the payment term in the contract was important to the client. The case was successfully fought and the client was able to continue to rely on and use its terms of business with confidence.

Defending Unfair Dismissal Claim Acted for an employer client in defending a claim brought by an employee for unfair dismissal arising out of redundancy situation. Principle law were requested to get involved as soon as there was an indication from an employee of an intention to make a claim to an Employment Tribunal. Principle Law immediately review the situation and gave clear advice and guidance to the employer on how best to handle the situation and assisted in the appeal process. The matter was resolved by amicable settlement and expensive litigation in the Employment Tribunal was avoided, saving the Employer substantial costs and risk of litigation.

Transport Law
|
Traffic Commissionaire Public Inquiry Complaints against client related to the failure in respect of the defects found on the vehicles and the maintenance of proper records. These were very serious matters and the client was at risk of losing its operator's licence. Principle Law represented the client at the public inquiry before the Traffic Commissionaire and were successful in avoiding the loss of the operator's licence and a hefty fine.

| Property Dispute |
Interest in
Property Dispute between a client and a third party as to ownership of a property. Objections made to enter a restriction at HM Land Registry. Property was registered in the sole name of one party. Issues arose as to whether a beneficial interest has been acquired in the property by the party whose name was not on the register at HM Land Registry. Questions arose as to whether there was an agreement or an understanding between the parties to give beneficial interest to the non-registered party; and further, whether contributions made towards legal fees; mortgage payments gave an interest in the property. The client won the case and also obtained an order for the recovery of his legal costs against the other party.
